Privacy policy and the use of cookies

This document contains the rules for collecting and using information about users on websites owned by Toscom Development sp. z o.o., as well as when placing orders for a free service provided electronically, which consists in the delivery of newsletters. The owner of the website is Toscom Development sp. z o.o. based in Wrocław, address: ul. Krucza 2a; 53-411 Wrocław, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000539197, REGON: 360596732, NIP: 8992761403, hereinafter referred to as “TOSCOM”.
The creation of the privacy policy and the use of cookies by TOSCOM is to draw users’ attention to the importance of protecting the privacy of users using the website www.toscom.pl (hereinafter referred to as the “Website”), while meeting the requirements imposed by the Act of 16 July 2004 Telecommunications Law (Journal of Laws No. 171, item 1800, as amended), the Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended) and the Act of 29 August 1997 on the protection of personal data (Journal of Laws No. 133, item 883, as amended) and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (Journal of Laws UE.L. 2016.119.1), commonly known as the general data protection regulation, i.e. the GDPR.
What personal data is collected and what is it used for?
TOSCOM collects and uses personal data and other information that is necessary for the proper use of the Website or the provision of services. Each time the user providing TOSCOM with their personal data is asked to consent to its receipt and processing by TOSCOM, unless otherwise stated in the content of the user’s notification addressed to TOSCOM. By completing and sending the Website’s contact form or subscribing to the newsletter, the user provides their personal data – name and surname, e-mail address and/or telephone number. It is also possible to transfer personal data in a different way, depending on the user’s needs, it may be an e-mail sent to TOSCOM in order to obtain information, initiate and conduct a complaint procedure or any other matter. TOSCOM requires the user to provide only the data necessary to provide the service or the task entrusted to them.
The controller of the user’s personal data is TOSCOM. The processing of personal data by TOSCOM is carried out on the basis of Art. 6 sec. 1(a), (b) or (f) of the GDPR. Providing personal data is voluntary. The Website User has the right to access personal data, rectify it, delete or limit processing, as well as the right to object, request the cessation of data processing and transfer their data, as well as the right to withdraw consent to data processing at any time and the right to lodge a complaint to the supervisory body. TOSCOM explains that, pursuant to the provisions of the Personal Data Protection Act, it may entrust the processing of collected data to other entities, but this does not apply to commercial use of information by third parties, but only to data management and processing.
In some cases defined by law, TOSCOM is required to disclose personal data and other information to public authorities in connection with the performance of their functions. In addition, it is worth remembering that the Website may contain links that allow users to go to other websites. The privacy policy and cookie policy of the owners of these websites may be different from the one used by TOSCOM and the user should become familiar with it in order to determine the manner and scope of using their data when using these websites.
The data provided by the user will not be profiled. TOSCOM will not transfer personal data to a third country or an international organization.
Users’ personal data will be kept for the period necessary to perform the service ordered by the user, to handle the inquiry made by the user or for another purpose agreed by the parties. Data processed for purposes resulting from the legitimate interests pursued by TOSCOM or by a third party may be processed until the expiry of the limitation period for claims arising from these legitimate interests. If, by submitting a relevant declaration, the user agrees to the processing of data for marketing purposes, the user’s data may be used for this purpose and will be processed until the consent given by the user is withdrawn. Such processing will consist in the transmission of information about products or services offered by TOSCOM or persons whose products or services TOSCOM will recommend.
As with personal data, TOSCOM may be required to disclose the information described above under applicable law.
Cookie Details
Cookies are small text information files sent by the Website and saved on the user’s end device (computer, laptop, smartphone). The purpose of cookies is to improve the use of the Website pages. They contain, among other things, the name of the website they come from and the storage time on the end device. TOSCOM uses cookies for the purpose of:
- more efficient adaptation of the website content to the user’s needs. Thanks to cookies, the Website recognizes the user’s browsing preferences and so, for example, the information is displayed only once for one user session and does not reappear after switching to the next page of the Website,
- creating statistics on the manner of using the Website by its users and assessing the popularity and efficiency of the Website. The statistics kept are anonymous.
The Website uses two basic types of cookies – session cookies and persistent cookies. Session cookies are temporary, they are stored until you leave the Website (by entering another page, logging out or turning off the browser). Persistent cookies are stored on the user’s end device until they are deleted by the user or for the time specified in their settings. In the web browser settings, the Website user may block the use of cookies or require the presentation of information about their placement on their device, however, some changes to the settings in the web browser may limit access to certain functions of the Website.
TOSCOM emphasizes that the cookie mechanism is not used to obtain any information about Website users or to track their navigation. Cookies used on the Website do not store any personal data or other information collected from users.
Information on minors
TOSCOM does not collect personal data from minors, but if, nevertheless, a person under 18 provides such data, TOSCOM will try to contact the parents or legal guardians, and if the parents or legal guardians find out that the transfer of personal data has taken place by a minor under their care, TOSCOM suggests contacting them in order to delete this data.
Security and changes
TOSCOM makes every effort to ensure that the Website and the collected data are subject to the best protection against loss, unlawful use or unauthorized access or modification. TOSCOM tries to protect all data of users with at least the same care as applied to its own confidential information.
In order to protect personal data and other information described in this document, TOSCOM applies security measures in the form of access passwords, restriction of persons with access rights and locating servers collecting data in dedicated rooms or giving them to specialized entities for management, in accordance with the principles imposed by applicable law.
Users have the option to resign from any ordered services, including free newsletters, and at any stage of data collection and processing, they may contact TOSCOM and request the deletion of data relating to them, including by sending an appropriate message to the e-mail address:

TOSCOM stipulates that with the development of the Website or a change in applicable law, or as a result of other circumstances, there may be a need or even an obligation to amend this privacy policy and the method of collecting or managing data. In this case, users will be immediately informed about the introduced changes in a manner that will enable them to become familiar with the new content.
