This document contains the rules for collecting and using information about users that apply to websites owned by Toscom Development Sp. z o.o. as well as when ordering a free service provided electronically, which involves delivering newsletters. The owner of the service is Toscom Development Sp. z o.o. with its registered office in Wrocław, address: ul. Krucza 2a; 53-411 Wrocław, registered in the National Court Register under the KRS number: 0000539197, REGON: 360596732, NIP: 8992761403, hereinafter referred to as "TOSCOM".
The creation of the privacy policy and cookie usage by TOSCOM aims to draw users' attention to the significant importance of protecting the privacy of individuals using the website www.toscom.pl (hereinafter referred to as the "Service") while simultaneously fulfilling the requirements imposed by the Act of July 16, 2004, Telecommunications Law (Journal of Laws No. 171, item 1800, as amended), the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended), the Act of August 29, 1997, on the protection of personal data (Journal of Laws No. 133, item 883, as amended), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Official Journal of the European Union L 2016.119.1), commonly known as the General Data Protection Regulation or GDPR.
TOSCOM collects and uses personal data and other information necessary for the proper use of the Service or the provision of services. Each time a user provides TOSCOM with their personal data, they are asked to consent to its receipt and processing by TOSCOM, unless otherwise specified in the user's submission to TOSCOM. By completing and submitting the Service's contact form or ordering a newsletter, the user provides their personal data - name and surname, email address, and/or phone number. It is also possible to provide personal data in another way, depending on the user's needs, such as an email message to TOSCOM for information, initiation, and conduct of a complaint procedure, or any other matter the user may address. TOSCOM always requires the user to provide only the data necessary to perform the service, or carry out the assigned task.
The administrator of the user's personal data is TOSCOM. The processing of personal data by TOSCOM is carried out based on Article 6(1)(a), (b), or (f) of the GDPR. Providing personal data is voluntary. The Service user has the right to access their personal data, correct it, delete it, or limit its processing, as well as the right to object, demand the cessation of processing and the transfer of data, as well as the right to withdraw consent to the processing of data at any time and the right to complain with the supervisory authority. TOSCOM explains that, based on the provisions of the Personal Data Protection Act, it may entrust the processing of collected data to other entities, but this does not apply to the commercial use of information by third parties, only to the performance of data management activities and their processing.
In some cases specified by law, TOSCOM is obliged to provide personal data and other information to public authorities in connection with the performance of their functions. It is also worth noting that the Service may contain links allowing users to go to other websites. The privacy policy and cookie policy of the owners of these websites may be separate from that applied by TOSCOM, and the users should familiarize themselves with it to determine the manner and scope of their data usage when using these websites.
The data provided by the user will not be subject to profiling. TOSCOM will not transfer personal data to a third country or international organization.
User personal data will be stored for the period necessary to perform the service ordered by the user, or handle the query submitted by the user or for any other purpose agreed upon by the parties. Data processed for purposes arising from TOSCOM's or a third party's legitimate interests may be processed until the statute of limitations for claims arising from these legitimate interests expires. If the user expresses consent to the processing of data for marketing purposes by submitting the appropriate statement, the user's data may be used for this purpose and will be processed until the user withdraws the consent given. Such processing will involve sending information about products or services offered by TOSCOM or by persons whose products or services TOSCOM recommends.
TOSCOM collects information about how users use the Service, their IP addresses, location data, and cookies. They are used to improve the operation of the Service, prevent security breaches, or conduct statistics on the functioning of the Service. Analyzing this information may, for example, allow an assessment of which region the largest group of users comes from or during which hours the servers and other devices serving the Service should operate at maximum efficiency.
TOSCOM emphasizes that the information collected in this way is not, in any way, linked to individual users and cannot be identified with personal data provided by users in another way.
As with personal data, TOSCOM may be obliged to disclose the information described above based on the provisions of applicable law.
Cookies are small text information sent by the Service and stored on the end user's device (computer, laptop, smartphone). The purpose of cookies is to facilitate the use of the Service's pages. They include, among other things, the name of the website from which they originate and the time of storage on the end device.
The Service uses two main types of cookies - session and persistent. Session files are temporary; they are stored until the user leaves the Service's page (by going to another page, logging out, or closing the browser). Persistent files are stored on the end user's device until they are deleted by the user or for the time resulting from their settings. In the settings of the internet browser, the Service user can block cookie support or require information about their placement on their device but some changes to the settings in the internet browser may limit access to certain Service functions.
TOSCOM emphasizes that the cookie mechanism is not used to obtain any information about Service users or to track their navigation. The files used on the Service do not store any personal data or other information collected from users.
TOSCOM does not collect personal data from individuals under the age of majority. However, if a person below the age of 18 nevertheless provides such data, TOSCOM will attempt to contact their parents or legal guardians. If parents or legal guardians determine that personal data has been provided by a minor under their care, TOSCOM encourages them to get in touch to have this data removed.
TOSCOM endeavors to provide the best protection for the Service and the data collected, to prevent loss, unlawful use, or unauthorized access or modification. All user data collected by TOSCOM is sought to be protected with at least the same diligence as its confidential information.
To protect personal data and other information described in this document, TOSCOM implements security measures such as access passwords, restrictions on authorized access personnel, and locating data-storing servers in designated premises or entrusting them to specialized entities by the principles imposed by applicable law.
Users have the option to unsubscribe from any ordered services, including free newsletters, and at any stage of data collection and processing, they may contact TOSCOM and request the deletion of data pertaining to them, including by sending a relevant message to the email address: biuro@toscom.pl or sprzedaz@toscom.pl
TOSCOM reserves the right that with the development of the Service or changes in applicable laws, or due to other circumstances, there may arise a need, or even an obligation, to make changes to this privacy policy and the way data is collected or managed. In such a case, users will be promptly informed of the introduced changes in a manner that enables them to familiarize themselves with the new content.
